crime and criminals

Judgment at Nuremberg (1961) is a fictionalized film account of the post-World War II Nuremberg Trials, written by Abby Mann and directed by Stanley Kramer, starring Spencer Tracy, Burt Lancaster, Richard Widmark and  Marlene Dietrich, among others.
The film depicts the trial of certain judges who executed Nazi law. It’s based on a real trial: the film was inspired by the Judges' Trial before the U.S. Nuremberg Military Tribunal in 1947. By the time the film was made, all of the convicts had already been released, including four of them who were sentenced to life in prison.

Watch Spencer Tracy delivering his final verdict :

    Dear teacher,
First I must thank you for the post. It’s really complete!!! But please have a break and give us a break too!
    :-)

The video is interesting because it has a lot of the vocabulary of crime, but I think it is very difficult to understand without the script.

The crimes I would punish with community service are burglaries, vandalism or pickpocketing, depending on the reasons that are behind the person who commit those offences. If nobody else gets injured, those could betheir sentences- Don't you think so?

I would give a life sentence to rapists, murderers and terrorists, no matter what is behind those people. But it’s true too that if someone commits those crimes it’s maybe because they are psychologically ill. But anyway they are dangerous people who should be in jail or shut away from the rest of the society.

Finally, I would like to say that the criminals from the video, those who killed thousands and millions of people in the nazi Germany, deserve life imprisonment, no matter what…

And I don't want to say Death Penalty because that is very controversial.

    Happy holidays to everybody

Life sentences must be given to offenders who are found guilty of murder. A judge may also choose to give a life sentence for serious offences, where the law allows, for example manslaughter, rape, armed robbery, bigamy, arson, child abuse, forgery, genocide, hijacking, smuggling, and so on.

Types of crime that can lead to a community sentence could be to steal a vehicle, damage property, fraud, threatening behaviour, assault. When a court imposes a community sentence, the offender doesn't go to prison. But the court says there are specific things the offender must do. Community services are designed to prevent more offences in the future. For example, getting training so they can find a job, complete a treatment programme to deal with drug or alcohol abuse or getting mental health treatment. And I wonder if they are good for something truly.

And finally, a new crime related to the new technologies is “Cyber bullying” which isn't just something that takes place on the internet. You can also be cyber bullied if you get abusive calls and text messages on your mobile phone called like bullying on mobile phones. Making offensive calls is actually a criminal offence. Anyone who is found guilty could have to pay a large fine. They may also be given a six-month sentence

In many countries when people commit offenses are punished with community service, but not all countries have the offense of life sentence. What is the situation in our country?

Spain operates the sentence with community service, but there is no life sentence, although I agree in applying life sentences for certain crimes.

Firstly, sentences of community service should be applied when offenders commit their first offense and this is small. We should also consider applying to young people between 16 and 18 because I believe that entering in prison in these cases is worse and perhaps with a community service is enough punishment for not re-offend.

Secondly, the life sentence I would reserve for the murderer who kill a person intentionally.

On the other hand, there are some people who think that the murderer should be sentenced with the death sentence. They believe in the topic "eye for eye, tooth for tooth."

In summary, I believe that the punishment should have two objectives: the payment of offence and the rehabilitation of offender. Rehabilitation should not be applied to people who kill a person intentionally.

Nowadays alot of people think that if you were declared guilty by a judge you would have to go to prison forever. Nevertheless, community services are a good idea to can come back society. I personally believe that it depends on what crime you have done to choose between community services or life sentence.
The firs and most important reason is that when you are charged with manslaughter, when you are caught having drugs or a unimportant theft the best verdict would be to do community services and courses to recognize your mistakes.
On the other hand, if you killed anybody with intention or deep hatred you would have to go to prison forever. There, you have to reflect on your crime and you should improve your life. Moreover, you can begin a new life studying a career and in the future you will be put on parole.
In conclusion, I believe that when you commit a crime without intention you must do community services guide towards rehabilitation to come back society soon. However, in my point of view if you kill anybody intentionly you will have to go to jail forever to reflect, although I think prisoners who improbe their behavior deserve freedom.

The prision punishments have always been a very controversial topic among people because all have different ways of thinking and interpreting the crimes. But in the end, is the law that decides what is the correct punishment.
First, when a person commit a manslaughter is very difficult to apply a penalty because it depends on the situation and how it happened. However, when this person is a murderer, I believe that he/she must be sentenced to life imprsonment.
On the other hand, not the same the penalty for thieves than for burglars because is more serious when a person invades a home to steal something, in that case, I think that the burglars should have a higher penalty. But it is much worse when the robbery involves some form of agression, and if it is intentional I believe that the crime is more worrying.
Depending on the type and gravity of crime that we have discussed, the law should be more or less rigurous with criminals, applying community services, penalty prison or death penalty when it required.

First, I think that a penalty that is applied in whatever form, should serve to achieve the reintegration of offenders. Why? because despite having acted against the law, it may have been committed for many reasons, for example by a necessity, because the offender has psychological disorder, etc ... and in many cases are unrepentant criminals. And for that, they should be given a second chance, always depending on the type of crime they have committed.

From here, knowing when to apply the penalty of community service and when a life sentence, it depends if the offenses are minor or more serious, and in the case of less serious, we must know if it is a crime or a fault.

So if I were a judge, I would apply penalties of community service provided they have committed an offense such as a theft (in Spain, theft is a fault if the value of what has been stolen is less than 400 euros, from here it becomes a crime). However, in the case of murder, terrorism, smuggling of drugs, women, children,... etc., I would applied a life sentence without any feeling.

Not to mention violence against women. But we can not forget that there is also violence against men. In any case, I would apply the penalty of life sentence in a psychiatric.

Difficult topic. I don´t agree with the laws in Spain. I don´t understand that a minor can rape and murder someone and not be condemned to prison.
I think you always have to study very well the offender, such as age, occupation, status etc. and what was the motive that led him to do that.
Nor I don´t agree with sentences in a foreign country. For example if I go on holiday to USA and put me drugs in my suitcase I haven´t reason to go to jail in that country. Furthermore, each country has different laws. I think the person who does something illegal in a foreign country should be repatriated to their country and be condemned there.
I'm sure God would say that we all need a second chance and that there shouldn´t exist capital punishment but what can we do with child sexual abuse, rape, missing children and murdered?
Can it be given a second chance that son of Satan when he didn´t give opportunity to their parents or family?

The sentence depends on the act and circumstances.
    Happy Easter.

First, I have to say that I don’t know anything about the laws in Spain, but sometimes I don’t agree with it.

This two stories are very similar because both of the stole something. In this case, I give a community service, but first the police have to investigate who was the thief.

On the one hand do community services should be given to people who stole, break something… They are people that sometimes don’t have anything to eat or they need that thing to leave. In this case, they can do community service but the government can help him giving him food, a place to sleep and at the same time they are helping the town. However, people who stole something to be better in their group of friends or only because they want to do, they have to do a worst community service and they are not going to win in order to receive something.

On the other hand, have a life sentence is not like I would like to be. I said that people go to the jail and they stay all they life living better than people outside. In spite of this is different in each prison a person who kills someone can eat, sleep in a “bed”, play football, basketball, get fit… And that’s all. Therefore If I don’t have a place to live I steal In a bank many times and I live better. This people must work there like Nelson Mandela Who spend 27 years working and living in bad conditions. There are a lot of people for example miners whose life are in risk, and there are many people in that situation. If you kill somebody you will go there to work, to do the hardest work and a judge shouldn’t give death penalty because they won’t’ suffer like theirs victim’s family.

I think that community services are a good system for minor crimes like robberies without violence, pickpckets, little drugs dealers and things like that, but not only that; they must go to a a rehabilitation point where they teach the way to live in society without hurt anybody. The same must be done with serious crimes, those criminals must stayed in the reabilitation point ( not jail )where differents professionals in psychology, medicine, law and others, work with them trying to turn them in better poeple.
Punishment or rehabilitation, what do you think is better?.

I totally agree with clint Eastwood. Furthermore, all sentences must include a period of time in community services, not only vandals or very young people. Imprisonment is not the solutions for crime; prison fails to rehabilitate offenders, so after their release they will continue with his misdeeds. Besides, life sentences are not considered appropriate as not let him to make his behaviour in a right way.
As far as I am concerned, I would wish that all offenders has to serve to the community as they committed actions against the law and prison not should be for life because, they should have the opportunity to change their mind and do the right things.

This is a topic difficult to treat. There are different opinions for and against capital punishment.
To begin with, many picpockets or shoplifters, go to jail by little robberys while big burglars as politicians, bankers are convicted with prison but they never give back the money.
On the other hand, we know that justice isn´t foolproof and inocent people could be convicted with capital punishment.Aren´t we murderers if we convict to capital punishment people?Fortunatelly, capital punishment doesn´t exist in our country.
In addition, I think that people in prisons would realize comunity work like doing roads, cleaning countryside, painting official buildings.Nowadays if you commit a crime you will stay at jail but you´ll have a lot of advantages. For example, you´ll be fed up,you´ll have a place to rest and you´ll have facilities to improve yourself.Everything is paid by citizens who haven´t committ any crime.
Taking everything into account, I´m against the capital punishment but I think the punishment should be harder because jails aren´t hotels.

I think it´s a dificult and sensitive topic, however, there are some logical reasons which explain how laws work diferent ways as offenses, has been comited.

In Granada, for example, there is a minor judge, which sentences are admired by his colleages and everybody. He says the most of offenses comited by minors can be resolve with comunity work, and he avoid to send them to the jail, because there is a social drama behind each criminal minor and it won´t help their future behavior.we should realise what terrible and frigtened is to spend one just day of our life in prison, when you are just a teenager.
On the other hand, offenses such as, rape, sexual child,in my opinion, must be punished with life sentence, because this kind of criminals never change their minds and they can do a lot of damage to inocent people

    hello Classmates!

As far as i am concerned, if somebody is charged with manslaughter, when he or she is caught having drugs or a unimportant theft the best verdict must be to do community services. Otherwise, cases like a murder must be punished with a life sentence.

That´s what i think, however, i have to say that my knowledge in law is really poor.

    See you soon!

Nowadays many robberies are committed, some of them are mores serious and dangerous than others.
People who make an offence can be sentenced by community services. In my opinion there are many cases like, rob a bank,a shop, or steal money, jewels, vandalism and so on,that would be condemn in this way and might be paying a fine.
On the other hand there are criminal cases more dangerous which I think would be accused for life sentence. For instance, people who rape, who make assassination.
Also there are cases which people are kidnapper, murder, terrorist and son on. This cases must be under sentence of death.

I have always doubted the fair or unfair that it may be that a person who is a legislator sentence punishment in advance of to do the crimes may be committed in many different ways, but otherwise I have always admired some judges who try to be just to the criminals who commit misdemeanors or without extenuating circumtance, these judges are who are imposing community services.
I agree in most cases, especially when thieves are harmless to people, when not used people not as a kidnapping, or when they are small-scale crimes related to ilegal downloads.
I will never agree to community service when it comes to genocide, terrorism, murder, rape or any crime related to abuse of power or violence in people.

Talking about this topic is always a bit controversial. There are many people who believe that laws are too soft with certain crimes and I agree with them. All of us can see the news on tv telling how many offenses are committed day after day without a proper punishment or this comes late and what is worse, many of them are committed by the same people once and again.
I strongly believe that the punishment should be stronger in certain cases as rapes, murderes and other serious crimes, but also with repeat offenders.

Any way, it is not only a matter of life sentence or comunity services but also to entirely fulfill the sentence whatever the years are. On the other hand minor offenses are which society should give another opportunity by giving them comunity services.

There are many types of crimes. Because of this, these have to be punished in different way.

In my view, we have to classify them according to three criteria:

    •Violent crimes and common crimes:
Violent crimes should be punished with capital punishment or life sentence if these were committed with intention, nevertheless, the jail would be enough for a manslaughter.
If it was a common crime, the punishment should be jail or community service, according to the seriousness, for example, robbing a bank is more serious than stealing an ice-cream.

    •Intention:
If you committed a violent crime, such as an assassination, a murder, or a rape, your intention should be the factor which determinate if you have to go straight to the electric chair, or simply, be sentenced to life sentence.
Capital punishment is frowned upon in Europe, but if your family or your friends received a shot in the neck from behind, maybe you would think otherwise.

    •Age of the offender
If a minor committed a crime, their parents should pay a fine and the criminal should do community service.
Anyway, I think when a minor is a criminal; his parents have failed to educate him.

First of all, I would like to give my opinion about decisions which are made in our country. I am totally against how people are punished here.
Nowadays, the law punish them how if all things they have done, they wouldn’t have been serious. For instance, when a man batters a woman, a restraining order is requested ando police don’t do anything more on the matter.
This order doesn’t protect women enough because when days go by, men kills them and so, they commit suicide. In the cases they still alive, they are taken to the court and sentenced to some years imprisonment and if they have a good behaviour, he can go out before anticipated.
If I were the judge, I would sentence him to a life sentence.
On the other hand, if people committed a crime such as robbery, forgery, drug deal… I would send them to prison, I would want they to pay a fine and do community service when they go out prison.
From my point of view, it is very sad to see how a man is sentenced with lots years of prison to work with ilegal profiles on Internet and how another man is sentenced to a few years and have the possibility of being on probation by having killed to a person.

Comunity services were applied for the first time in EEUU with women who commited traffic ofences as an alternative to imprison them. It was seen as an oportunity to solve the problem of overcrowding in prisons. No violent criminals, who had been imprisoned in another way, got the chance to perform comunity services instead of being imprisoned.
Comunity services are commonly used in cases of younger criminals who break the law. This punishment helps to these younger wrongdoers to rehabilitated them into society, to avoid the prison involved them in a life of crime and to become them in law-abiding citizens.
From the economic point of view, comunity services are much more beneficial for the state because the criminals continue to live in their houses and we do not have to pay for them. Thereby, the offenders contribute with the society instead of taking something away.
On the other hand, there are many people who think that comunity services do not dissuade these infractors from commiting more offences and they need stronger punishments.
Finally, in my opinion comunity services are a completely viable alternative to execute sentences, although always of petty crimes of course. But I do not think that they were the right option to apply always and in a general way. There are minors who commit serious offences so there should be stronger punishments for them. At the same time, comunity services could be a good option for adults with have commited not so important crimes.
